User Agreement & Terms of Service

Welcome to the platform (the “Site”). By creating an account, accessing the Site, purchasing products, participating in trades, using messaging features, or otherwise using any services provided through the Site, you agree to be bound by this User Agreement and Terms of Service (“Agreement”).

If you do not agree to these terms, you may not use the Site.

1. Definitions

1.1 Site

The term “Site” refers to the platform, website, applications, marketplace systems, collection registries, trading systems, messaging systems, group-buy systems, and all related services operated by the platform.

1.2 User

A “User” is any individual or entity that accesses or uses the Site.

1.3 Member

A “Member” is a registered User with an active account.

1.4 Commissary

The “Commissary” refers to the Site’s fixed-price marketplace and related programs.

1.5 Bazaar

The “Bazaar” refers to the Site’s user-priced marketplace.

1.6 Politburo

The “Politburo” refers to the Site’s invite-based elite collector membership program.

1.7 Party Loyalty Points

“Party Loyalty Points” refer to reputation and trust indicators assigned by the Site.

2. Eligibility

2.1 Minimum Age

You must be at least 18 years old to create a primary account. Minor accounts may only exist as subordinate or linked accounts managed by a verified adult or primary account holder.

2.2 Legal Capacity

You represent that you have the legal capacity to enter into binding agreements.

2.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and while using the Site.

3. Membership and Account Types

3.1 Free Accounts

Free accounts may browse the Site and purchase products where permitted. Free accounts may have limited visibility and restricted access to messaging, trading, and other features.

3.2 Paid Memberships

Certain features, including trading and direct messaging, require an active paid membership. Membership fees are non-refundable except where required by law.

3.3 Retail Accounts

Retail or Local Card Shop (“LCS”) accounts are subject to additional verification requirements. The Site reserves the right to approve, deny, suspend, or revoke retail status at any time.

3.4 Politburo Membership

Politburo membership is limited, invite-based, discretionary, and revocable. Participation in the Politburo program is not guaranteed and may be terminated at the Site’s sole discretion.

4. Marketplace and Trading Disclaimer

4.1 User-to-User Transactions

The Site acts solely as a platform facilitating communication and transactions between Users. The Site is not the buyer or seller of cards, collectibles, hobby products, or any other items listed by Users.

4.2 No Guarantee

The Site does not guarantee:

• transaction completion
• product authenticity
• product condition
• shipping performance
• pricing accuracy
• user conduct
• trade fulfillment

4.3 Assumption of Risk

Users assume all risks associated with trading, purchasing, selling, shipping, and interacting with other Users.

4.4 Shipping Responsibility

Users participating in trades are individually responsible for their own shipping arrangements, costs, packaging, insurance decisions, and tracking.

5. Fees and Payments

5.1 Platform Fees

Marketplace fees may apply to purchases and sales. The Site reserves the right to modify fee structures at any time.

5.2 Payment Processing

Payments may be processed through third-party payment processors. The Site is not responsible for payment processor outages, freezes, holds, disputes, or reversals.

5.3 Taxes

Users are solely responsible for determining and paying any applicable taxes.

6. User Conduct

Users agree not to:

• scam or defraud other Users
• misrepresent products
• manipulate prices or markets
• engage in harassment or abuse
• threaten other Users
• upload illegal content
• violate intellectual property rights
• use automated scraping or bots without authorization
• exploit Site vulnerabilities
• interfere with Site operations
• evade bans or restrictions

The Site reserves the right to investigate and take action against violations.

7. Party Loyalty Points, Ratings, and Reputation

7.1 Informational Purpose Only

Ratings, Party Loyalty Points, badges, trust indicators, and reputation systems are informational only. The Site does not guarantee that any User is trustworthy, legitimate, safe, authentic, or reliable.

7.2 Manipulation

Attempts to manipulate ratings, Party Loyalty Points, feedback systems, or trust metrics may result in suspension or termination.

8. Politburo Program Terms

8.1 Invitation and Sponsorship

Politburo invitations may involve sponsorship or vouching by existing members. Sponsors may be subject to internal trust consequences if sponsored members violate Site policies.

8.2 No Investment Program

The Politburo program, group buys, and Commissary systems are hobby and collector programs only. Nothing on the Site constitutes:

• securities offerings
• investment contracts
• financial advice
• guaranteed profits
• business partnerships

8.3 Group Buy Risks

Participation in group buys involves inherent risks including allocation shortages, cancellations, distributor issues, delays, price changes, damaged products, and manufacturer limitations. Users acknowledge and accept these risks.

9. Intellectual Property

All Site branding, logos, text, graphics, software, layouts, and systems are owned by the Site or its licensors. Users may not reproduce, copy, distribute, or commercially exploit Site content without permission.

Users retain ownership of content they upload but grant the Site a worldwide, non-exclusive license to host, display, and use such content for Site operations and promotion.

10. Account Suspension and Termination

The Site reserves the right to:

• suspend accounts
• terminate accounts
• remove listings
• revoke badges
• revoke Politburo access
• restrict features
• remove content

for any reason, including suspected fraud, abuse, scams, policy violations, or conduct harmful to the community. No refund is guaranteed for terminated memberships.

11. Disputes Between Users

11.1 Platform Limitation

The Site is not obligated to mediate disputes between Users.

11.2 Optional Assistance

The Site may, but is not required to, assist with dispute resolution.

11.3 Final Decisions

Any moderation or dispute decisions made by the Site are final.

12. Limitation of Liability

To the maximum extent permitted by law, the Site and its owners, operators, employees, contractors, affiliates, and partners shall not be liable for:

• indirect damages
• incidental damages
• consequential damages
• lost profits
• lost collectibles
• lost packages
• fraud by Users
• emotional distress
• reputational harm
• marketplace losses
• data loss
• service interruptions

Your use of the Site is at your own risk.

13. Indemnification

You agree to indemnify and hold harmless the Site and its operators from claims, damages, liabilities, costs, and expenses arising from:

• your use of the Site
• your transactions
• your uploaded content
• your violations of this Agreement
• disputes with other Users

14. No Warranty

The Site is provided “AS IS” and “AS AVAILABLE” without warranties of any kind. The Site does not guarantee uninterrupted operation, security, availability, or error-free functionality.

15. Privacy

Use of the Site is also governed by the Privacy Policy. Users acknowledge that no system is completely secure and that data transmissions may involve risks.

16. Modifications to Terms

The Site reserves the right to modify this Agreement at any time. Continued use of the Site after modifications constitutes acceptance of the updated terms.

17. Governing Law

This Agreement shall be governed by and construed under the laws of the applicable jurisdiction determined by the Site operator.

18. Severability

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

19. Entire Agreement

This Agreement constitutes the entire agreement between Users and the Site regarding use of the platform.
